		<description>In most countries common law is not legally recognized so what you had in Canada may not be legally accepted in elsewhere. Marriage is a pain to undo, but it does confer legal rights that common law does not have. Many in Canada  think that common law still has power. Not since they amended the laws for gay marriage. In essence Canada gave more legal power to those who are legally married and took some rights away in in effect to common law.</description>

		<description>Whilst the one-year residence rule required in Canada to recognise a foreign divorce was intended to eliminate quick divorce havens, in my case, it also eliminated a Decree Absolute made 20 years ago by a British Crown Court. Domicile, not residence, is used to determine UK divorces, particularly recognising that many Euro nationals inhabit and reside in each others&#039; countries without relinquishing their legal ties (on which domicile is based) to the &#039;homeland.&#039; Canada is too parochial to appreciate this concept and uses the more restricting &#039;residence&#039; equation. I have returned to Canada to reside and have been informed by a lawyer I retained to write my letter on why he should accept my foreign divorce that the conflict of laws between Canada and the UK has disqualified me. In an unusual turn of events, my former spouse and I wish to remarry in Canada. To our surprise, we now find we were never divorced and are still legally married in Canada. We have made wills and executed various other legal processes in Canada as man and wife.</description>
